Northwestern Energy Company Claims “Failure to leave after smelling gas” as Defense in Natural Gas Explosion Death

NorthWestern Energy Natural Gas believes it’s not liable for a woman’s death because of she “failed” to leave a building even though “gas could be smelled”.

Tara Reistad, 36, died in the gas explosion after it demolished half a city block in downtown Bozeman. Her husband is suing Northwestern Energy claiming there was a “crack in a threaded joint on a 2-inch service line behind Montana Trails Gallery “had deteriorated, becoming brittle, dangerous and defective”, while the gas company claims the “installation, maintenance and operation of the service line complied with state law”.

Due to the fact that the gas line did explode, and did destroy “half a city block”, we can’t help but wonder what the Montana state laws are regarding gas pipelines and the companies that install, operate, and maintain them.

As for the company’s defense, that they aren’t liable because the woman didn’t leave even though “gas could be smelled”, there’s the issue of the woman’s ability to smell the gas. Not everyone has a great sense of smell which, can sometimes, be hampered by offsetting factors such as a cold.

What is cold is the gas company’s defense. There’s no doubt they’ll spend as much, or more, in attorney fees defending their suit when they should do the “right thing” and settle with the victim’s husband.
