Persuading the Anti-Gun Left: Attorney’s Fees To Do What the Constitution Couldn’t?
Conservatism 101: D.I.Y. Political Education
Tomorrow night is New Years Eve and Da Tool Guy pulls down the curtain on 2011, not by burying lawyers and their fees, but by PRAISING them! Mix in equal portions of Heller v DC and the antics of the anti-gun Left and you have the ingredients for this week’s Conservatism 101. Could million-dollar attorney’s fees persuade the Lefties where the Constitution failed?

CONSERVATISM 101:
#59 – Attorney’s fees

A federal judge has ordered the City of Washington D.C. to pay more than $1 million in attorney’s fees to the attorneys who fought the Heller case.
The Heller case was, of course, the case which overturned the city’s three-decade old gun ban.
D.C. changed their laws when the Supreme Court told them to, but Dick Heller has since sued the city again because the laws they passed were so restrictive as to be a defacto ban.
I’m not going to argue the idiocy of gun bans here. Most of my readers already realize how ineffective they are anyway — at least as a crime prevention measure.
No, I’m simply going to note that judgements like this might actually be more effective than supreme court decisions in liberalizing gun laws.
Cities are generally notoriously broke. They’re also generally lawyer-averse.
What we have here is something which might actually break the dam in some of the major cities which still do their best to restrict self-defense.
This is a tactic which the left has used against us for years in a slightly different form. Groups like Greenpeace and the Environmental Defense Fund file basically frivolous lawsuits and then tell major corporations “pay us and we’ll go away.”
Here we have a variation on the tactic.

“Change your law, and we won’t sue and you won’t have to pay us.”
How well this is likely to work I’m not certain. For so many of the antigun left (well that would be the entire left I guess) this is something on the order of a religious crusade and we’ve all seen how unwilling they are to back down, even in the face of overwhelming facts.
Regardless, this is a positive development and I suspect we’ll see more cities rethinking their gun laws in the wake of this.
