Judge blocks parts of Arizona immigration law:
PHOENIX – A federal judge stepped into the fight over Arizona’s immigration law at the last minute Wednesday, blocking the heart of the measure and defusing a confrontation between police and thousands of activists that had been building for months.
Coming just hours before the law was to take effect, the ruling isn’t the end.
It sets up a lengthy legal battle that could end up before the Supreme Court — ensuring that a law that reignited the immigration debate, inspired similar measures nationwide, created fodder for political campaigns and raised tensions with Mexico will stay in the spotlight.
Arizona governor, Jan Brewer, called the ruling a “temporary bump in the road.”

In essence, Judge Susan Bolton bought the Justice Department’s preemption argument — i.e., the claim that the federal government has broad and exclusive authority to regulate immigration, and therefore that any state measure that is inconsistent with federal law is invalid. The Arizona law is completely consistent with federal law. The judge, however, twisted to concept of federal law into federal enforcement practices (or, as it happens, lack thereof). In effect, the court is saying that if the feds refuse to enforce the law the states can’t do it either because doing so would transgress the federal policy of non-enforcement … which is nuts.
However this ruling came out, it was only going to be the first round. Appeal is certain. But the gleeful Left may want to put away the party hats. This decision is going to anger most of the country. The upshot of it is to tell Americans that if they want the immigration laws enforced, they are going to need a president willing to do it, a Congress willing to make clear that the federal government has no interest in preempting state enforcement, and the selection of judges who will not invent novel legal theories to frustrate enforcement. They are not going to get that from the Obama/Reid/Pelosi Democrats.
As sovereignty is erased when a border is erased, there is no longer an America, just Mexico North. We are an annex to a garbage heap.

What will be interesting will be to see whether this impacts public opinion. The Obama administration has taken a beating in the polls on this issue, with poll after poll showing majorities of Americans supporting the Arizona law. A temporary injunction on portions of the bill may get some people rethinking the issue, but I’d be surprised if there was any substantial movement. If a judge later rules against the law after a full hearing, it might change feelings about the law specifically, but probably not about enforcement.
I’d also expect the White House to claim this as vindication, but only because they have been utterly tone-deaf on this issue for the last three months. They should wait on the I-told-you-so for the full hearing.

The vast majority of the public supports immigration enforcement. S.B. 1070 promised to make such enforcement a reality. For the moment, the public will has been defeated, which is why S.B. 1070’s effect on illegal immigration was the one aspect of the law that neither the Obama administration or Judge Bolton dared to address.
The great divide in this country is not rich vs. poor, black vs. white, the haves vs. the have-nots.
After the ruling of Judge Susan Bolton, the great divide in this country is plain for many Americans to see: it is the Obama administration vs. the Will of the People.
As with the ramrodding of ObamaCare through a CONgress on a strictly-partisan vote, in defiance of the American people, the ruling today of Judge Bolton, in granting a government injunction against the state of Arizona to protect its citizens, is a slap in the face of a wide majority of Americans who favor rule of law, fair play and the equal application of the law.
This governing in spite of the people instead of in their name is an abomination. This politicization of justice will come back to haunt, not only this administration, but Democrats in general.
The same Obama Justice Department that stops purges of voter rolls, throws out won cases of voter intimidation and drags its feet to make sure that Military voters won’t be disenfranchised – again, worked up the resources to go to bat for those who are in this country illegally–but will probably be inclined to vote Democratic.
Laugh it up chump. You’ve got 3 more months before the hammer comes down; 5 more months until subpoenas start ripping the lid off the hidden, rotten collection you’ve assembled in Imperial DC.
The United States is not Chicago–though it’s been governed like it was for the last 18 months.
That’s 18 months too many. Five months more to go.
Americans are a hardy breed: they will get through the next 180 days.
Then your regime will crumble even faster than it has the last 12 months.
