Disturbing Executive Order that Obama signed Sunday grants Interpol immunity from subpoenas, searches, FOIA–in short, it allows Interpol to collect data on US citizens without any redress. A ‘separate’ Interpol agency has been created in the DOJ. This is wrong on a variety of levels.

Extra-constitutional?

Unconstitutional?

Criminal?

A naked Executive branch power grab?

Or, just a signing away of sovereign U.S. rights that American citizens enjoyed until this was signed?

EXECUTIVE ORDER

AMENDING EXECUTIVE ORDER 12425 DESIGNATING INTERPOL
AS A PUBLIC INTERNATIONAL ORGANIZATION ENTITLED TO
ENJOY CERTAIN PRIVILEGES, EXEMPTIONS, AND IMMUNITIES

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 1 of the International Organizations Immunities Act (22 U.S.C. 288), and in order to extend the appropriate privileges, exemptions, and immunities to the International Criminal Police Organization (INTERPOL), it is hereby ordered that Executive Order 12425 of June 16, 1983, as amended, is further amended by deleting from the first sentence the words “except those provided by Section 2(c), Section 3, Section 4, Section 5, and Section 6 of that Act” and the semicolon that immediately precedes them.

Here’s one take that paints a disturbing–but accurate–picture. Hint: not much paint is needed.

Nudge, nudge folks… This seems a minor change but let us break it out for you as we see it. Let’s look at the section from Executive Order 12425.

Here’s the text of 2(c), which this Executive Order now has applying to Interpol:

(c) Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation. The archives of international organizations shall be inviolable.

This now says that Interpol is no longer subject to the Freedom of Information Act. Their premises or staff can no longer be searched either. Their files are not subject to legal subpoena or discovery. Our government could just hand documents and files over to Interpol and Americans would no longer have access to them. Interpol can legally keep files now on all citizens of the US with no right to redress.

In reality, we have just handed over our sovereignty. Interpol headquarters in the US is currently headquartered in the Department of Justice. A ‘separate’ Interpol agency has been created in the DOJ – let that sink in for a moment. Interpol has been granted diplomatic immunity now by Obama – they have exemption from being subject to search and seizure by law enforcement, US taxes and immunity from FOIA requests, etc. This action could also be used to divulge American military secrets and a whole host of horrific practices having to do with going after our military. It’s the road to internationalism on steroids.

That’s quite a bad scenario. In fact, it’s quite bad–but it’s not the only horrifying scenario.

Now for another scenario.

Here’s an entity–residing in the Department of Justice–to which files, executive branch information, in short, any information that the President does not want Congress or the press to see–where “inconvenient” info can be dumped that’s beyond the power of most to bring to the light of day.

The government has plans which some might see as unconstitutional? Drop the file off at Interpol and–voila!–it’s no longer a problem for congressional subpoenas.

That takes care of any changes in Congressional make-up that might come about due to the 2010 tsunami that’s building off-shore right now.

How can this be Constitutional?

How can Congress stand for this?

How can the press stand for this?

This Congress has shown itself to be corrupt and able to be bought off–maybe the White House is planning on using TARP money to buy off any pesky congressmen or senators?

The Press has shown itself to be “compliant” to the White House’s wishes, demands and claims. It’s hard to believe that the White House press corps won’t question Robert Gibbs about this? Hopefully, there will be strong follow-up questions.

Maybe there’s an innocent explanation about this. But we can’t think of any right now.

To use an Obamaism, this is truly “unprecedented” on a variety of levels.

Truly, Richard Nixon must be asking himself, “Why didn’t I think of that?”

Compared to this White House, Nixon was bush league when it came to naked power grabs.

UPDATE #1: Forgot to put this in the original, but there’s more good analysis of this dog of an executive order at NoisyRoom.net. (Link above). I’m waiting for a lawyer to weigh in. Am I over-reacting here? Is this ‘unprecedented’ in the normal sense of the word–or in the Obama sense (which would make it no big deal)…

UPDATE #2 Dec 30, 09–Just What Did President Obama’s Executive Order regarding INTERPOL Do?.

A little over a week later, ABC’s Jake Tapper has a more benign view of the Executive Order at the link above. We trust Tapper, who is no member of the Obama lapdog media. But even Tapper admits that records with Interpol in the USA are beyond the reach of law enforcement “though, officials say, those provisions can be waived by the president if need be.”

The comments on Tapper’s article raise many important points, including our take on Tapper “burying the lede” by leaving the above sentence until the last of the piece.

    Have you never heard of a ‘liason office’? Interpol has no enforcement ability. None. They don’t do investigations. They don’t do arrests.

    Magno said the arrest warrant allows the government to ask Interpol for assistance in locating and arresting Ivler in case he has fled the country. An Interpol “red notice” is usually issued for wanted persons based on an arrest warrant.

    Two American nationals wanted by the US federal authorities have been arrested in the Philippines, the Bureau of Immigration (BI) announced Saturday.

    Floro Balato Jr., BI-Interpol Unit chief, identified the arrested Americans as Jeffry Tye Brown, 49, and Paul Daniel Hogg, 67.

    Balato said Brown and Hogg were arrested in Dumaguete City last December 16 and in Cagayan de Oro City on December 17, respectively, by BI-Interpol units.

    My God! Do they know that they have no arrest powers? Maybe they didn’t investigate first and that let them off the hook?

    Maybe Interpol doesn’t know they’re not supposed to be involved in investigations? From Interpol’s site:

    INTERPOL’s role

    # providing investigative support to member countries in ongoing international fugitive investigations with a view to locating and arresting wanted persons.

    Oh no! Interpol’s not read your comment! Jon H, you’d better contact them! Quick!

    See? I guess there is a problem. Maybe they just haven’t heard from you yet?

    However, arrests and investigations–while the specter is troubling to say the least–was not our biggest concern in the piece above. The fact that information about Americans is off-limits–in America–beyond the FOIA, beyond law enforcement is the most troubling thing, IMO.

    But you’re OK with that.

    ..and we’re all morons, so the matter’s settled.

    Obama is a Radical Muslim who is determined to bring down the US. And he is well on the way to doing it. He wants Islam to take over the world.

    Islam is not a peaceful religion— the Koran requires true belivers, (Muslims to convert all Infidels, Christians and Jews, and if they will not convert to Islam they are to behead the infidels.
