Let’s say you’re a Democrat and let’s say you’re running for president of the United States.
You’re a likable guy and are doing well–the New York Times and AP think you’re peachy–but there have been whispers of whether or not you are constitutionally qualified.
A prominent Democrat files suit in Federal court asking you to provide proof, to settle the matter once and for all.
What do you do?
- A. Provide the court with the three documents in question and go back to shaking hands, making promises and smiling for the cameras.
- B. Provide images of one of the documents to a friendly website to post, but not to the court.
- C. Ignore the request, then make a motion to dismiss the case, in lieu of providing the proof.
- D. In the meantime, quietly, post a notice at your website, FighttheSmears.com that you had dual citizenship with Kenya.
- E. Hire the top gun attorney from the Council of American-Islamic Relations (CAIR) to fight the case.
- F. File a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss (which was) filed on 09/24/08, thereby putting the matter off until–hopefully–after the election.
Time’s up. What do you do?
Most readers sensibly chose A.
But, if you’re Barack Obama, you chose answers B, C, D, E and F.
A curious response for a campaign interested in “fighting the smears”.
What’s the big deal? Regular folks provide their birth certificates every day for any number of reasons: obtaining a driver’s license or marriage license come to mind. Heck, even kids have to provide a certified copy of their birth certificates to register for kindergarten in many locales.
Most people do it–if they’re able–without much grumbling.
And they’re not even running for President.
As DBKP kept asking for ten long months during the John Edwards’ scandal:
“If there is nothing to hide, why is everyone involved going to such lengths to hide it?”
The Lawsuit of Phillip J. Berg
On August 22, we reported that attorney Phillip Berg had filed a suit in Federal court. [Denver Dem Convention: Clinton Supporter Files to Disqualify Obama]
The suit was against Barack Obama and the Democrat National Committee. It asked the court to force Obama to prove he was an American citizen.
Seems reasonable.
Do what thousands of Americans each day do–especially after 9-11: provide a birth certificate or proof of U.S. citizenship. It’s a minor inconvenience, but they do it.

A prominent Philadelphia attorney and Hillary Clinton supporter filed suit this afternoon in the U.S. District Court for the Eastern District of Pennsylvania against Illinois Sen. Barack Obama and the Democratic National Committee. The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.
Phillip Berg, the filing attorney, is a former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. According to Berg, he filed the suit–just days before the DNC is to hold its nominating convention in Denver–for the health of the Democratic Party.
“I filed this action at this time,” Berg stated, “to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.”.
The suit asked for three documents:
- 1. a certified copy of Obama’s “vault” (original long version) Birth Certificate;
- 2. a certified copy of Obama’s Certificate of Citizenship; and
- 3. a certified copy of the Oath of Allegiance taken by Obama taken at the age of majority.
To date, attorneys for Barack Obama have filed almost as many motions fighting the lawsuit(2), as the number of documents the suit is asking for(3).
Again, that seems like curious behavior for a candidate anxious to dispel rumors about his qualifications and citizenship.
Why would that be?
We asked Phillip Berg.
“It’s my belief that he [Barack Obama] can’t produce the documents.
“If Obama cannot produce a certificate of citizenship, that would make him an illegal alien. In that case, he should be arrested, tried and deported.”
Senator Obama could put this whole thing to rest by providing an official “vault copy” birth certificate. The fact that he’s fighting it shows me that he can’t produce the documents.”
Again, that sounds reasonable to us.
On September 24, the day before Obama posted his dual citizenship admission on FighttheSmears.com, his legal team filed (with the DNC’s lawyers) a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss.
Berg’s been quoted as saying that this action “outraged” him.
“[T]his is another attempt to hide the truth from the public; it is obvious that documents do not exist to prove that Obama is qualified to be President.”
Their joint motion indicates a concerted effort to avoid the truth by attempting to delay the judicial process, although legal, by not resolving the issue presented: that is, whether Barack Obama meets the qualifications to be President.
We asked Berg: Why would Obama do this? Why not just produce the documents? Why delay discovery–effectively ensuring that the documents will not have to be produced until after the election?
“I can only assume that if Obama wins, they will then claim that you cannot sue a sitting president.”
Oh.
Dual Citizenship?
Two weeks ago, the Obama campaign did another curious thing.
On September 25, at Obama’s FighttheSmears.com, the campaign admitted that Barack Obama had had dual citizenship: that he was a citizen of both the United States and Kenya.

The Obama website cites the Anneberg Political Fact Check/FactCheck.org statement–which is the position of the Obama campaign, by the way.
“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.
Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”
For someone involved in a lawsuit over citizenship, admitting that Obama had had dual citizenship at this juncture didn’t seem particularly helpful–or likely to quiet those asking questions.
We asked Berg about this.
“The dual citizenship with Kenya–that’s a smokescreen. Kenya allows dual citizenship. Kenya is not the issue.
The Obama campaign never mentions Indonesia–and won’t. That’s a problem. When Obama moved to Indonesia and attended school, he was adopted or acknowledged by Lolo Soetoro; Indonesia didn’t allow dual citizenship.”
As Berg wrote in his court filing, Berg v. Obama, No. 08-cv-04083.
Obama lost his U.S. citizenship when his mother married an Indonesian citizen, Lolo Soetoro who legally “acknowledged” Obama as his son in Indonesia and/or “adopted” Obama, which caused Obama to become a “natural” Indonesian citizen. Stanley Ann Dunham Soetoro relocated herself and Obama to Indonesia wherein Obama’s mother naturalized in Indonesia. This is proven by Obama’s school record with the student’s name as “Barry Soetoro”, Father’s name: Lolo Soetoro, M.A., and Citizenship: Indonesia.
Hmmm. And what does the Obama campaign have to say about all of this?
Nothing.
One begins to understand why Obama’s lawyers chose to file motions instead of producing the documents in question.
Berg: “We got him. The fact that he’s not produced any of the documents settles it.”
The Elusive Birth Certificate of Barack Obama
Questions come to mind and to us, at least, they seem reasonable.
1. Why won’t the Obama campaign provide Obama’s birth certificate to a federal judge–who has ordered Obama to do so? Instead, the campaign and the DNC have filed a motion to dismiss that has yet to be ruled upon.
2. Why did the Obama campaign provide digital images of a birth certificate to FactCheck.org that had been altered–either by the campaign or FactCheck.org–and why did FactCheck.org state that the images had never been altered? It was quickly proved that they had been.
3. Why did FactCheck.org have to fact check their own June 12 2008 fact check post on the Obama birth certificate? That is curious behavior for a site that is supposedly a neutral referee on political questions.
4. Why has the Obama campaign fought every attempt–except those carefully controlled by campaign operatives during their interaction with Anneberg Political Fact Check/FactCheck.org–to produce a valid original birth certificate?
5. The document provided FactCheck.org by the Obama campaign very clearly has the following at the bottom: “This copy serves as prima facie evidence of the fact of birth in any court proceeding.” Yet, rather than produce that document so it can be examined in a federal court, why has the Barack Obama hired the Council of American-Islamic Relations (CAIR) top “hit man” lawyer to prevent this from happening?
6. Why is it that the document the Obama campaign has shown to FactCheck.org NOT been shown to others in the media–outside a few digital images to friendly MSM papers? There certainly are enough Mainstream Media organizations which double as Obama campaign PR shills–they would be more than happy to pronounce their satisfaction with it.

In reaction to some of the comments left below challenging the veracity of the document, Ben LaBolt, an Obama campaign spokesman, sent the following reaction to The Ticket: “I can confirm that that is Sen. Obama’s birth certificate.”See how easy that was to do?
But, apparently, there was too much grumbling among the peasants, so the LA Times had to revisit the issue in August.
In Obama’s case, there has been rampant online speculation that his birth certificate is forged or altered somehow. Well, the folks at FactCheck.org say they have seen the certificate, touched and vouched it — Obama is as American as baseball, apple pie and, these days, burritos, pasta and kung pao chicken.
So that should settle it … unless … wait … the people at FactCheck.org use computers, with keypads, that have the letters r-e-z-k-o on them, which just happened to spell the name of one of Obama’s disgraced former backers … and they were in Chicago to see the birth certificate at … Obama headquarters … CONNECT THE DOTS, PEOPLE!
Ta da!
Just as FactCheck.org and Politicheck would do in their pieces, anyone with further questions would be labeled as “conspiracy theorists”.
Where had we heard that term before?
“Conspiracy theorist” was one of the charges Edwards’ supporters leveled at DBKP when we kept writing about the curious facts of the John Edwards affair. Since the National Enquirer hasn’t had any stories about Obama’s citizenship, “tabloid trash” hasn’t been used yet.
Readers may suspect that the traditional Mainstream Media would be no help in all of this–and readers would be right. Just as they did in the John Edwards Scandal, the MSM refuses to fulfill their duties as an adversarial press–unless the candidate is named “Sarah Palin”.
Just as CNN, ABC, CBS, NBC, Time, Newsweek, The New York Times, Washington Post and the rest of Big Media refused to investigate the John Edwards affair–not one MSM reporters asked the presidential candidate one question for over 10 months about the curious set of circumstances surrounding him and his mistress, Rielle Hunter–there has been no serious investigation into the growing controversy of the citizenship of Barack Obama.
Other than report what the Obama campaign has given them, the MSM has conducted no investigations. As in the Edwards affair, catch phrases are substituted for investigation.
Two of the favorites must be:
“That’s what the campaign is saying? Works for me.”
“Conspiracy theorists–bah!”

From FactCheck.org “Has Obama’s birth certificate been disclosed?” – June 16, 2008
We asked for and received a copy from the Obama campaign. It is too large to display full size on this page, but you may click on this link to see a copy of the document just as we received it.
FactCheck.org further stated at the time, in a post that could have been written by the Obama campaign itself, “But the document should put to rest groundless speculation raised on some conservative Web sites that Obama might not have been born in the U.S. and therefore might not qualify under the Constitution as a “natural-born citizen” to be president.”
The speculation was not based on any evidence. Bloggers raised questions based on the absence of evidence, specifically the lack of a publicly available copy of a birth certificate and the supposed “secrecy” surrounding it. For example, the conservative World Net Daily posted a June 10 article with the headline, “Is Obama’s candidacy constitutional?; Secrecy over birth certificate, demand for ‘natural-born’ citizenship cited.” Soon after, some of our readers began asking us the same thing.
The “secrecy” ended when Tommy Vietor at the Obama campaign sent a message to us and other reporters saying, “I know there have been some rumors spreading about Obama’s citizenship, so I wanted to make sure you all had a copy of his birth certificate.” A digital image was attached.
Hawaii state law forbids the release of birth or marriage certificates to anyone but the persons named in the documents or their immediate relatives. This copy carries a date stamp of “Jun 6 – 2007″ (which has bled through from the reverse side), and is, therefore, probably a copy obtained by Obama himself at that time.
In early June, various PUMA members contacted DBKP and asked us to look into the Obama birth certificate charges. We had just finished debunking Larry Sinclair, the man who had accused Barack Obama of sharing sex and cocaine in the back of a rented limo. [DBKP Library of Larry Sinclair stories]
On June 12, DailyKOS released its now-infamous forgery of what it claimed was Obama’s birth certificate.
The KOS document was not only was a forgery, it was a bad one.
On June 16 the FactCheck.org piece appeared. At that time, we hastily concluded that the Obama Birth Certificate story should be assigned to the “rumor” category. Several conservative sites that we trust made the same judgment.
As was stated, we were hasty.
But others were not.
Particularly, Atlas Shrugged’s Pam Geller and Yid with Lid.
Geller contacted a document fraud expert who ran a variety of tests on the FactCheck images. The Atlas piece raised so many valid questions about the digital image that the Obama campaign had initially provided, FactCheck fact checked itself–almost immediately after Obama returned from his vacation to Hawaii–and posted other images of the elusive birth certificate at FactCheck.org on August 21.
FactCheck.org began the strangely-worded post (which was updated on August 26):
In June, the Obama campaign released a digitally scanned image of his birth certificate to quell speculative charges that he might not be a natural-born citizen. But the image prompted more blog-based skepticism about the document’s authenticity. And recently, author Jerome Corsi, whose book attacks Obama, said in a TV interview that the birth certificate the campaign has is “fake.”
We beg to differ. FactCheck.org staffers have now seen, touched, examined and photographed the original birth certificate. We conclude that it meets all of the requirements from the State Department for proving U.S. citizenship. Claims that the document lacks a raised seal or a signature are false. We have posted high-resolution photographs of the document as “supporting documents” to this article. Our conclusion: Obama was born in the U.S.A. just as he has always said.
“Meets all of the requirements from the State Department for proving U.S. citizenship”.
Odd choice of wording, but maybe not.

The FactCheck.org post continued in an unusual vein–for a site in the business of checking facts. The post was one part fact, one part sleight-of-hand, one part folksy pablum and one part hurling names at those who has raised reasonable questions on this matter.
The certificate has all the elements the State Department requires for proving citizenship to obtain a U.S. passport: “your full name, the full name of your parent(s), date and place of birth, sex, date the birth record was filed, and the seal or other certification of the official custodian of such records.” The names, date and place of birth, and filing date are all evident on the scanned version, and you can see the seal above.

There’s that passport thing again.
Is this going to be the line of argument the Obama campaign takes in the future?
The document is a “certification of birth,” also known as a short-form birth certificate. The long form is drawn up by the hospital and includes additional information such as birth weight and parents’ hometowns. The short form is printed by the state and draws from a database with fewer details. The Hawaii Department of Health’s birth record request form does not give the option to request a photocopy of your long-form birth certificate, but their short form has enough information to be acceptable to the State Department. We tried to ask the Hawaii DOH why they only offer the short form, among other questions, but they have not given a response.
The scan released by the campaign shows halos around the black text, making it look (to some) as though the text might have been pasted on top of an image of security paper. But the document itself has no such halos, nor do the close-up photos we took of it. We conclude that the halo seen in the image produced by the campaign is a digital artifact from the scanning process.
We asked the Obama campaign about the date stamp and the blacked-out certificate number. The certificate is stamped June 2007, because that’s when Hawaii officials produced it for the campaign, which requested that document and “all the records we could get our hands on” according to spokesperson Shauna Daly. The campaign didn’t release its copy until 2008, after speculation began to appear on the Internet questioning Obama’s citizenship. The campaign then rushed to release the document, and the rush is responsible for the blacked-out certificate number. Says Shauna: “[We] couldn’t get someone on the phone in Hawaii to tell us whether the number represented some secret information, and we erred on the side of blacking it out. Since then we’ve found out it’s pretty irrelevant for the outside world.” The document we looked at did have a certificate number; it is 151 1961 – 010641.
Fair enough, so far.
But, all of that bowing and scraping to Obama camapign officials took its toll. Time for a little FactCheck.org sneer for any who had the brass to question FactCheck.org’s original “fact check”
We also note that so far none of those questioning the authenticity of the document have produced a shred of evidence that the information on it is incorrect. Instead, some speculate that somehow, maybe, he was born in another country and doesn’t meet the Constitution’s requirement that the president be a “natural-born citizen.”
We think our colleagues at PolitiFact.com, who also dug into some of these loopy theories put it pretty well: “It is possible that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies. Anything’s possible. But step back and look at the overwhelming evidence to the contrary and your sense of what’s reasonable has to take over.”
Phillip Berg seemed reasonable to us. What did he have to say about this?
“There’s nothing in our system that requires that a candidate must prove his qualifications are true and correct before he or she runs, and that safeguard should be put into our system by law.
“That’s one of the reasons why I filed the lawsuit.”
“It is possible that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies.”
Although the good folks at Politifact might think the scenario played out that way, we’re not much given to conspiracy theories.
Anyone who’s spent much time trying to prove their identity after having their driver’s license stolen or lost these days, knows that government bureaucrats rarely exhibit the ambition or initiative such a conspiracy would entail.
A much more likely explanation is that most folks do not have a Kenyan father–or an adoptive Indonesian father. Combine that fact with the fact that most bureaucrats are more skilled at looking at checklists than performing detailed document investigation, and it seems very possible a mistake may have been made somewhere along the line.
It only had to happen once; most license renewals are automatic–long as the applicant can show their previous license.
It seemed strange that two organizations–supposedly interested in checking facts– would show such contempt toward people asking them to, well, check some facts. After all, FactCheck.org didn’t exactly set the world on fire in its initial fact check.
FactCheck’s post then displayed an image of a birth announcement from the August 13 1961 Honolulu Advertiser.
Again, that’s nice. But, FactCheck.org knows that the birth announcement, in and of itself, isn’t much more than window-dressing.
The following claim was also posted at FactCheck.org: “You can click on the photos to get full-size versions, which haven’t been edited in any way, except that some have been rotated 90 degrees for viewing purposes.”
However, it didn’t take long to prove that this was one “fact” that wasn’t, in fact, a fact.
From FactCheck.org’s Credibility in Question:
Shown below is a spreadsheet that lists, for each of FactCheck’s photo files, the original file name and size, the current file size, the dates that I downloaded each of them, and the percentage of file compression applied to each of the original files.

By subjecting the original set of COLB photos to these extreme percentages of file compression, without also reducing the image sizes, what you get are photos that look as large as the original ones, but are blurry, fuzzy, and totally useless for detecting any detail in them, detail, that someone like myself, just might use to prove that FactCheck intentionally altered their photos and scan image to perpetuate a fraud on the American public.
That seems like curious behavior for a site dedicated to “fact checking”, doesn’t it?
Others thought so too. It didn’t take long until FactCheck.org was again fact checked–and, once again, their facts were found wanting.

More Questions, No Answers
Texas Darlin’s concerns was not so breezily dismissed by the FactCheck post. The FactCheck.org image of the newspaper birth announcement came from her site.
FactCheck.org Has New Birth Certificate Story [Update x2] – August 21, 2008.
Interesting, indeed. I have the following questions for Factcheck. Since they are so on-top of this story, I’m sure they have answers:
1. What took the campaign so long to show an actual document to the media?
2. What other media did the campaign offer to show the COLB to, and have any others seen it and touched it, handled and photographed it? Or only Annenberg-owned Factcheck?
3. Why did the campaign go to such trouble to digitally black out the certificate number when it could have stuck a piece of solid black tape over the number, especially since, as Factcheck reported, they were in such a hurry?
4. Why did Janice Okubo tell a reporter that the COLB was ordered “this month” (June 2008 ) if it was ordered in June 2007?
5. Since Factcheck is seemingly in the business of helping the Obama campaign fight smears, did Factcheck ask the campaign about the rumor that Republicans are holding Barry Soetoro’s birth certificate? If so, what was the campaign’s response? If not, why not?
And finally…
6. How did end up getting this access? Did they ask the campaign, or did the campaign offer to show it to Factcheck? The article is mysteriously vague on that point: “FactCheck representatives got a chance to spend some time with the birth certificate.”
Questions a reasonable person might ask, especially 1,2,4 and 6.
DBKP’s LBG had a few reasonable observations, “Obama, Bill Ayers, and FactCheck.Org: All Have Ties To Annenberg Foundation:
Again, regardless of whether the certificate is authentic or not, DBKP finds the fact that Obama’s attorney chose to file a motion to dismiss rather than just handing over a certified copy of the birth certificate to the judge puzzling. Everyday ordinary citizens have to prove citizenship by providing a certified copy of their birth certificate in order to obtain a driver’s license or an ID card.
We cannot fathom why the Obama camp chose the motion to dismiss instead of complying with a Federal judge’s order to provide a certified copy of Obama’s birth certificate.
The Obama campaign handed over a copy to Factcheck.org, why the “stall” with handing a copy over to the Federal Judge handling the Berg lawsuit?
If the Obama birth certificate is on the “up and up” then releasing it to a Federal Judge should be a “priority” of the Obama campaign instead of filing “motions to dismiss”. After all, the rest of us ordinary Average Joe’s have to fork over a copy of our birth certificates every now and then to prove we’re citizens in order to get something as mundane as a driver’s license.
We imagine most citizens would comply with a judge’s order to supply a copy of our birth certificate without too much fuss. Obama, an attorney himself, must surely realize the consequences of disobeying a judge’s order.

Produce the documents and make the case go away.
Then, Barack Obama can go back to promising a chicken in every pot and health care in every garage and less taxes–on the house–for everyone except the evil rich.
DBKP can go back to asking questions about “Just Who Exactly is Barack Obama and why are so many of his past associations shrouded in secrecy and his past documents so difficult to obtain?”
We didn’t weigh in on the citizenship issue earlier: we erroneously thought that FactCheck.org was a neutral fact checker.

Sure, we know that we’ll get swarmed by the usual suspects in the comments section calling us names for noticing these curious behaviors.
We’re used to it.
The Edwards minions attacked us from the Left during the months it took the John Edwards story to come out.
During our investigation of Larry Sinclair, we were labeled “Obamabots” (Stop it, you’re killing me!) and worse by some on the right.
We’re glad that others, like Atlas, Texas Darlin and Yid with Lid, pursued this while we were busy with other stories. But now, we consider these questions of Obama’s citizenship–as well as the little-publicized past associations, statements and actions of Barack Obama–to be the story to which we should devote our small resources.
We hope our readers will assist us, as they did with the John Edwards’ story: with tips and places for us to look and facts to check.
Is Barack Obama constitutionally qualified to be the President of the United States of America?
We don’t know.
But, because we’re now curious, we’re going to be asking some questions in the next four weeks.
Beginning with: “Why is Barack Obama not doing what thousands of Americans have to do every day?”
Produce proof of citizenship.
NOTE: We should include Texas Darlin as one of the sites who was not satisfied with FactCheck.org’s fact checking. We forgot to include TD. Sorry!
NOTE #2: Clarification – It was inaccurate to say the judge has demanded the documents: the judge in Berg v Obama has not ruled on various motions yet. It is more accurate to say that Phillip Berg, in his court filing asked for the three documents in question.
60. Plaintiff has asked for a simple resolution. Plaintiff has asked that Obama supply a genuine certified copy of his original long version “vault” Birth Certificate, A Certification of Citizenship and a certified copy of his Oath of Allegiance. If in fact Obama can prove his “natural born” citizenship status, which he cannot, then he has not been prejudiced in anyway, but instead Plaintiff has been protected and his civil rights secured. However, if Obama is unable to supply said documentation, then he needs to withdraw his candidacy, again which will eliminate Plaintiff’s deprivations and instill Plaintiff’s constitutionally protected safeguards and rights.
We apologize for the mistake. We referenced another article, posted this article and just arrived back at the office. We hope no one was inconvenienced by this oversight in the 9 hours, 50 minutes it stood. This mistake does not affect our post’s premise. There have been a few minor changes in the choices offered in the quiz (B & C) to more accurately reflect the correct info.

There is nothing “curious” about hiring a lawyer and moving to dismiss a silly suit like this one. And, by the way, the court did NOT order Obama to do anything. The purported document circulating on the internet is not a court order but a proposed order submitted by the plaintiff as required by local rules. This lawsuit will meet a quick and deserved dismissal, but I’d rather have you guys focus on nonsense like this instead of addressing the issues the American people care about in the worst economic crisis since the depression. That’s why “That One” is headed for a landslide victory on November 4th.

Hey Drama queen… the ecomony of 1980 1981 was far worse then our current condition. The One is heading for a landslide victory because too many people have their fingers in their ears and the media will not do its job. There is nothing wrong with asking for proof of their citizenship. You or I would have to do the same thing if we ran.

I had heard about the rumors involving Barack Obama’s birth certificate since the summer, but assuming they were petty right-wing nonsense, I never bothered checking up on them. I happened to stumble-upon this site (strangely enough, using (Firefox’s Stumble-Upon feature), and spent the requisite time to read the entire saga from prologue to epilogue.
My original estimation was correct.

I actually am having a good day – Obama is up 11 points nationally in the Gallup poll for the second day in a row, and is now, for the first time, ahead in West Virginia for the first time – up 8 points, according to the ARG poll just released today. West Virginia!
With respect to the birth certificate nonsense, those of your readers who would like to get the real facts from an objective source can go to http://www.factcheck.org/elections-2008/born_in_the_usa.html, to read about and see the genuine Hawaii birth certificate for Senator Obama, as well as the birth notice published at the time in the local Honolulu newspaper. (I know – his parents must have forseen that they would need to fake his natural born citizenship when he was born, in case he wanted to run for President.)
Really, you know when Ronald Reagan was running for President, conservatives appealed to American voters by talking about ideas – free enterprise, limited government, civil liberties. That was the high road, and it worked. It’s sad to see what the movement has become 28 years later. No wonder real conservatives like Charles Krauthammer and George Will are so despondent about what’s happened to formerly intellectual conservatism.

Here is the thing, if the public is curious about this innocuous issue, Obama should simply provide it. If Obama feels people are a bit too conspiratorial, it would serve him well to laugh about it , blow it up, and explain the contents in front of a friendly crowd. It would get huge play and be a good joke.

I can not imagine that anyone serving in any governmental office did not have to prove their citizenship with a birth certificate. Racism is well an alive in our United States but remember latinos and blacks are the growing majority. Be nice cause we are. A very good report in spite of your last minute claifications.
Even though I am a Democrat and find this unbelievable, the fact that some of your readers simply blink at this really shows what a fine sense of patriotism and respect for the rule of law they have.
The core of a civilized society, whether it leans to or is totally to the left or right, is the rule of law, for without it, there is anarchy. The respect anyone shows by producing pertinent documents when requested is the respect to that rule of law. So, why would a constitutional lawyer refrain from doing so?

TIME OUT! Let’s get something straight here. The court has not ordered, has not requested, has not suggested, that Obama produce anything in this case. The only things that have happened are that plaintiff filed his suit, and Obama’s lawyers have moved to dismiss it on the grounds that it doesn’t state a valid claim under the law. The court has not yet ruled on that motion. (As a constitutional lawyer for more than 30 years, i can tell you, having read the papers, that the odds of the court dismissing this case outright are very, very high.) The “court order” floating around on the internet is a proposed order written by plaintiff stating what he wants. Senator Obama has not ignored anything and is following the exact legal procedures any defendant would.
The posters on the internet who circulate this sort of misinformation are the lowest purveyors of dirt around.
Le’s get back to a campaign of issues and ideas.

It would seem that Senator Obama, who’s never been accused of not being an astute politician, would want to settle this quickly and settle all questions. That he has not makes us curious.
The issue: Is Obama consitutionally Qualified? We clearly stated that we don’t know. Senator Obama could help out on this one. That’s he’s responded in a variety of curious ways caught our attention. One of those was the timing of the post about his dual Kenyan citizenship on his website the day before his lawyers made the motion to dismiss. Millions of Americans don’t keep their vault birth certificates so secretive. Why does Obama?
The idea: We ask questions–especially when others in the business of asking don’t do it and instead buck up campaign lines.
As a constitutional lawyer, surely you’d agree that questions should be asked and answered whenever possible.
Or perhaps not.

I’m not curious at all, because there really is no question in my mind. Obama was orn in Hawaii and the factcheck research thoroughly satisfies me. I don’t have the “vault copy” of my birth certificate either, just a certified copy like Senator Obama has. Interestingly, the real constitutional question is whether John McCain is constitutionally eligible to be President. I think he has the better side of the argument, but there are constitutional scholars who disagree. He was born in the Panama Canal Zone. At the time, the naturalization laws defined a “natural born citizen” as someone born in the United States or its Territories (defined) or born in a foreign country to American citizens. McCain doesn’t fit either of these categories. The Canal Zone was not a U.S. Territory in the definition of the statute, and McCain, though born to US parents, wasn’t born in a foreign country. Congress later amended the statute to include the Canal Zone, but there is dispute about whether this could retroactively make McCain a “natural born citizen”. As I said, I’d rule for him on that issue, but it’s a real issue unlike this stuff.

Amazing how much effort went into this effort to stop the clear front runner in the campaign. I have done my own research and have concluded that the copy presented is a modern and official certified COPY of the birth certificate for Hawaii. There can be plenty of reasons that a “Vault” copy cannot be secured. They are usually stored on microfiche. If not stored properly…i.e. subject to humidity, the microfiche would deteriorate. Correct me if I’m wrong, but isnt there a lot of humidity in Hawaii? Has anyone done research on a possible fire that might have destroyed records? An incompetent file clerk that might have lost it or failed to microfiche it, or mis-filed it? Instead of being so quick to call our future President Obama a liar, try using some common sense for a change and give him and us a break.

Skinny, better go re-read my post. I said that people claiming that Obama was not qualified to run for President based on his BC were as WRONG as the people saying that McCain couldn’t run cos he was born in Panama. Both are qualified to run. It’s a non-issue. People want to keep stirring the pot, let em’.
As for Edwards, you’re talking to the wrong person, pal. I sounded the alarm to my progressive brothers and sisters when the NE first broke the story last year, but nobody wanted to listen. And after Edwards escapade at the hotel, again, nobody (at least on my side of the aisle) wanted to pay attention. Nobody wanted to believe that Edwards could be such a slime bag.
This election couldn’t be more simple. If you want four more years of Bush, then vote for McSame. And if you do and he wins, don’t come crying to me afterwards when your 401k is shredded more than it is now, you lose your health care, and we’re embroiled in Iraq (or another neo-con war) for the next hundred years.

H aha ha ha … OR we can take the neo-liberal approach and take a quick turn towards socialism. Personally I think 4 more years of Bush sound better right now, and Bush has pissed off Republicans (particularly Conservatives) more than he has the left. Ours outrage isn’t nearly as blind or empty. That being said… I’d rather vote 90% of the time with Bush and disagree 10% of the time with him (perhaps a 10% is all we really need), than vote 97% of the time with the dismal Democrat majority in the senate… which has a worse approval rating by the way.
McCain quickly showed his proof, disproved any rumors and did so without any questions, probes or lawsuits.
However OBAMA on the other hand cannot, or will not, and is attempting to delay this case past the election… which prompts even more questions and doubts as to his legitimacy in this race. If I were Howard Dean or any other Democrat leader, I too would be making an extra effort to make this a non-issue, however they have not and THAT is why the right will continue to probe, doubt and ask questions.
May I remind you that it was a Democrat that even brought this to the table?

Total Posts: 304 Joined 2006-11-19 On August, 21, 2008, prominent lawyer, Hillary supporter, former Pennsylvania Democratic Party official and former Pennsylvania Deputy Attorney General Philip J. Berg, filed a suit in Federal court in Philadelphia alleging that, because of several factual situations, Obama is not a “natural born citizen” as the Constitution requires all candidates for President to be (see http://obamacrimes.com/) and he uses as proof, among other things, the testimony of Obama’s paternal grandmother, a half-brother and half sister who say they witnessed that Obama was born, not in Hawaii as Obama claims, but in Kenya.
Most of these allegations could instantly be proven false if Obama were to produce the original, long form copy of his Hawaiian birth certificate for examination. Obama has consistently refused to do this and, instead, Obama’s campaign website and his online supporters have offered images of a shorter Hawaiian “certificate of live birth,” that many questioned documents experts say is a forgery and, doesn’t definitively answer the question anyway.
Now, in legal motions filed in Federal court by attorneys for Obama and the DNC this past Monday, October 6th, Obama and the DNC request that any “discovery” in this case, i.e. the actual production and examination of Obama’s original Hawaiian birth certificate, which Berg alleges does not exist because Obama was born in Kenya, be deferred until other legal issues are settled, in effect, postponing production of the birth certificate in question until after the November 4th Election.
This is truly a “Constitutional Crisis” and a Crisis for our Legal System and one that the MSM—deep, deep in the tank for Obama–wants no part in telling us exists, much less covering; you would think that the MSM would at least cover this story to debunk it and for a few laughs but, had I not gone to Berg’s website, I would not have known of this latest legal move, which was invisible because not reported by the MSM. The fact that Obama will not just produce this document—a thing easily done and likely to win him many political points, while at the same time, damaging his political enemies–to settle the issue, and the fact that Obama and the DNC are willing to spend money on delaying production of this original birth certificate, tells me that Obama doesn’t have one, because it doesn’t exist and if it doesn’t exist, Obama is disqualified from running for the Presidency, his campaign collapses and Obama, Democrats in general and the Democratic Party are thoroughly discredited and forever indelibly stained by this monumental fraud on the American people and our country’s democracy; thus, the stakes for Obama, for Democrats, for the Democratic Party and, most importantly, for our democratic form of government, could not be higher. I am sure there is much frantic activity behind the scenes and that the pressure on the Federal judge hearing this case is enormous.
Can you think of any sane reason why Obama would not pull out his original birth certificate for examination and immediately settle this bothersome, costly and “distracting” suit and this controversy? I can’t.
Obama and the DNC, aided by the silence of the MSM, want to keep this Federal suit, these developments, as unknown and quiet as possible, wants the action to be over before we even know that it happened; I suppose the likes of Greta Van Susteren wants to cover the monumentally important story of OJ’s new trial and tribulations, instead.
Obama and the DNC are hoping that if Obama wins in November, Obama’s Presidency will be a faite accompli, no one will have the guts or will want to go through the monumental Constitutional Crisis and Crisis in our Legal System that would ensue if attempts were made to remove a Constitutionally disqualified President-designate Obama from his position. The potential for riots in the streets by Obama’s outraged black supporters (always a threat of implied violence useful to Democrats) is only one of the many dire scenarios one can easily conjure up. Democrats control Congress and all the chairmen of key committees that would be involved in such a Constitutional Crisis are hard-core Democrats. The Democrats probably figure that once they win, they can try every trick in the book, they will fix this problem somehow and evade blame, play dumb, throw up a confusing barrage of conflicting information, say that the citizenship requirement is just an archaic “technicality,” unfair and unimportant, point fingers and say they didn’t realize there was a “Crisis,” and can count on most people to not want to “make waves,” “rock the boat,” or to want to be part of such a potentially cataclysmic upheaval endangering the peace and tranquility and the very fabric of our democracy–so, one way or the other–the Democrats will smooth things over and make this suit go away, to enter the Bermuda Triangle of unsolved and endlessly disputed controversies like the disappearance of Judge Crater, Chappaquiddick and the Kennedy Assassination.
So, the time to act is now, before the Election and the necessary awareness leading to calls for such action is what Obama and the DNC are trying to prevent, with their legal maneuvering and the MSM is also trying to prevent by their silence on this suit and this issue.

The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.

If you look it up the court minutes are on the net, he was ordered to produce not only the “vault bc” but a copy of his oath, for recitizenship from Indonesia considering he couldn’t be going to school there without citizenship and at the time there were not offering duel citizenship so we will see on that one as well. Hmm maybe that explains the not wearing of the flag lapel pin and the hand not on his heart. Oh and I’m not a republican until recently I was purely democratic, now I define myself as an independent.

Bree – The Court has not ordered Obama to produce ANYTHING. All that’s happened in the case is that plaintiff has filed the complaint, and defendant has moved to dismiss it for lack of standing, a motion the court has yet to rule on. The so called Court Order circulating on the net is a proposed order by plaintiff, which local rules require be submitted with plaintiff’s request for injunctive relief.
Voice of reason – Hawaii had no such law and could not have such a law because individual states cannot define who is a US citizen – that is a matter of federal law.

For me this is not so much an issue of if he is or is not an American citizen. I believe he very well likely was born in Hawaii. My issue is if that is the case and there is nothing to hide why not just produce the documents and lay the matter to rest. Also I don’t so much have an issue with where he was born as i do with other aspects of the lawsuit which in a nutshell claim that even if he was a natural born citizen he no longer is considered as that because they moved to Indonesia, and his step father had to either adopt him or acknowledge him as his for him to be able to go to school there. Ok so now that would not be a big deal except when he did that it made him a citizen of Indonesia as at that time they didn’t allow duel citizenship. For Obama to then come back to this country he would have had to go through immigration which would make him a naturalized citizen not a natural born and therefore could not run for president. also interesting to note that on the documents that show that he went to school in Indonesia it also shows his listed religion as Islam, not that I have a problem with his religion other then I think he has been less then honest on this issue as well and that is what I have an issue with. The Lawyer bringing this suit against him is a long standing Democrat, this was not a right wing issue the left side is bringing it against their own because they see this as wrong and they are right. For all those that think this is a “SILLY” issue i say you couldn’t be more wrong I believe Obama to be secretive and I’m sorry if he’s not a natural born citizen regardless if he was to begin with or not but if he is not considered that at this point should be taken off the ticket. Well, it is a quite valid point. Particularly if he is disqualified from running by becoming an Indonesian citizen (which did not allow joint citizenship at the time). Why is it that when this topic comes up in a conversation with liberals… the subject is quickly changed to either McCain’s tax plan or Palin’s inexperience (to which 99% can’t back up their statements in an argument).
It could have all gone away with a quick response and proper documentation… however that failed to happen.
This is either poor judgement on Obama’s part or a giant spotlight shining closer and closer to a much bigger issue.

The Dems in Hawaii will stonewall any effort to get the birth certificate verified. As quidid00 wondered where are the armies of reporters that descended on Alaska to destroy Sarah Palin? I believe if they descended on Kenya near the Jomo Kenyatta International Airport and found a hospital (s) nearby that took care of “foreigners” you’d likley find someone who remembered the case. A woman denied access to an international flight because of final stages of pregnancy who delivered soon after. Also I would guess a flight with a mixed race couple and a recently born male child of mixed blood arriving in Hawaii by air would have some record of arrival in US Customs. I’m not a researcher but I think I can do better than the so called media hounds. What a bunch of bovine fecal matter, fact is the Dems and the media elite don’t want to get the real answer. Obama’s mother must have told him at some time what hospital in Hawaii he was born in. In ‘61 there weren’t that many. Just show us a real birth certificate with raised seal like I had to show to get into the military and be done with it. Fact is he can’t!

Over the last month (24/7), I, while diligently keeping an open mind, took on the arduous and sometimes challenging task of conducting my own intense research relating to each Presidential candidate’s background, as a means of educating myself prior to casting my vote. In the process of accomplishing my task, I have discovered that, although, both candidates seem to have skeletons in their closets, I continue to have more concerns about casting my vote for Sen. Obama, even though I am a registered democrat, due to my numerous unanswered questions relating to his background (e.g., who he really is, where he came from and, most important, what he stands for).
Along with a candidate’s knowledge, skills and abilities, I also consider their honesty, integrity, character, judgment and moral values to be just as important, especially when I am casting my vote for a candidate that will be our next President and who, among other demanding duties and responsibilities, will also be charged with setting the example for all of us. Although, some of my previous candidate decisions have been proven to be wrong, which I am man enough to admit, they have not caused me to get disillusioned and will not stop me from making this and other educated Presidential candidate decisions.
I am also concerned that, over the years, our society’s moral values seem to have hit rock bottom and, sadly, I attribute some of this to be a direct result of us electing individuals that, by their own actions, have been proven to have a gross lack of leadership skills, along with little or no moral values, which continues to negatively affect our image here at home, and, just as important, other countries around the world that expect us to set a positive example of a democratic society for others to follow.
Electing a President that has a proven track record of having excellent leadership skills, which includes being honest and trustworthy, along with a transparent background, is a must for me. This was set in concrete after 44 years of experiencing the tragic results of electing individuals into leadership positions, who, upon being elected, have proven to have had hidden agendas prior to being elected into those positions.
I believe that this happened mainly because, as candidates, they knowingly and purposely misled the public by promising everything under the sun, even if they, in their own hearts, knew that most of those promises were unachievable, along with making a concerted effort of not doing or saying anything that might rock the boat, which would subsequently raise too many eyebrows. These actions were put into place, solely, as a means of getting elected into a leadership position and, thereby, having the opportunity to put their hidden agendas into practice. The results of these actions usually ended up in negatively and permanently affecting other individuals, their families and major institutions (e.g., financial crises, fall of Enron etc.).
On one hand, we have a candidate who’s actions have historically been transparent and, although he may not be an eloquent and charismatic speaker, he does have a proven track record of being honest and trustworthy. He also has a record of saying and doing what’s on his mind and in his heart, which includes being man enough to admit any and all mistakes and/or poor judgment decisions that he may have made in his long career as a public servant. All this without worrying about whether or not others may think less of him for doing so. And, most important, he consciously continues to make decisions and/or take actions that are considered to be in the best interest of his constituents.
On the other hand, we have a candidate who’s personal/career actions have not been as transparent with a seemingly shady background, but comes across as being an extremely eloquent and charismatic speaker, who promises all of us everything under the sun and goes out of his way to say only those things that he knows his audience wants to hear, which in this case is the American public. (e.g., during his 30 minute infomercial he changed his tax breaks for those making less than $250,000 to $200,000?).

All this hooplah about birth certificates is interesting and Barack Obama’s reaction to it more so. However, the real story to me is the psyche of this man. Beginning in the late 1950s, his mother chose to shock her parents’ mid-western, middleclass Christian values by sleeping with foreign-born Muslims and dragging her mixed race children around the third world. His alcoholic womanizing Kenyan father abandonnded him as a boy. When his mother found herself dumped and adrift in Indonesia, she sends Obama home to be raised by the same square, mid-western parents she so obviously disdained. By all accounts this poor young man did everything to please his grandparents, make friends and win people over. He was the recipient of much good will in terms of education and advancement. Yet, he associates himself with people who make terrible claims against the racists nature of our country and people like his grandparents. He himself, has said and done many things over the year’s implying America is a racist country even though he and his wife have been the very fortunate recipients of much affirmative action largesse. It’s as if he can’t direct his anger and hatred at the people who deserve it – his parents. That is to be pitied not elected!

I’m not an expert at anything and I don’t have a fancy college degree. I also don’t care if this thing is nothing but a “vast right-wing conspiracy.” The only thing I know is that this whole silly thing has been going on for months with the clear announcement that it would all go away if Obama simply produced a valid birth certificate. This is something which he still has not done. Why not? The only conclusion I can draw is that he does not have one, is not a citizen, and for his own illogical or insane reasons, has decided that he can run for President anyway even though the Constitution clearly says he can’t.
I don’t care how charismatic or well spoken he is. I don’t care how charmed African-Americans are to have a Black President. I don’t care if there are riots in the street. I don’t care if the Democratic Party is tarnished by this for the next 100 years. The only thing I care about is that there has been a colossal fraud perpetrated on the American people by an egocentric, self involved, megalomaniacal criminal who was aided and abetted by syncophants who were only interested in their own power and advancement. If it is true that Obama is covering up his non-citizenship in order to be President, then he should be in prison not in power.
Trying to dismiss this problem by saying that it’s sour grapes by unhappy conservative losers won’t make it any less a crime. What does the Constitution really mean if we are willing to set it aside whenever it inconveniences us? If we are willing to ignore Obama’s criminal behavior, which is breathtaking in it’s chutzpah and scope, why not dismiss it altogether? What do we need a Constitution for anyway? Judges rewrite it all the time to do their own social engineering so why not throw it out so our latest “Rock Star” can reign?
This is not a “small thing” because it is only about citizenship. We either respect our Constitution or we don’t. If we don’t want our Constition anymore we should get rid of it. If we want it we should follow it and obey the laws it enumerates. Anything less is hypocritical.

On November 4, 2008 those voting for Barack Obama may in fact have voted for a non-candidate in the presidential election.
Obama refuses to answer mounting lawsuits in various states regarding whether or not he was born as an American. All it would take to clear up this question would be for him to produce a legal copy of his actual birth certificate, which to-date he has refused to do. If you believe that Obama went to Hawaii to only see his Grandmother then; where was Michelle and why were the girls not allowed to see their Great-Grandma “Toot” for the last time??
Folks get a grip. This Obama trip to see Grandma ‘Toot” was put together with ABC and Good Morning America as a two-fold attempt to, 1) legitimize a Publicity stunt to gain sympathetic favor for Obama and, 2) provide a cover for Obama to solicit a legal story and affidavit from Grandma ‘Toot” as to his claim of having been born in Hawaii.

And I want to make sure that I don’t miss that opportunity right now.” “And then we’re going to find out what chores I can do, because I’m sure there’s been some stuff that’s been left undone,” he said.
Yes, there was good reason that Obama needed to “talk with her and find some chores that need to be done!” And it’s very important that you the voter decipher his words “she’s still alert and she’s got all her faculties.” He keeps repeating this mantra because that’s an absolute requirement for a valid affidavit. And Grandma “toot” was the only American relative left that could cover-up his birthplace.
Obama’s other grandmother on his father’s side, half brother and half sister claim Mr. Barack H. Obama was born in Kenya. Reports further reflect that Mr. Obama’s mother went to Kenya during her pregnancy. Wayne Madsen, Journalist with Online Journal as a contributing writer published an article on June 9, 2008 stating that a research team went to Mombassa, Kenya, and located a Certificate Registering the birth of Barack Obama, Jr. at a Kenya Maternity Hospital, to his father, a Kenyan citizen and his mother, a U.S. citizen. There are claims of records of a “registry of birth” for Obama, on or about August 8, 1961 in the public records office in Hawaii, but these have not been released for scrutiny. It is alleged in the various lawsuits and is a matter of much general speculation that Mr. Obama’s mother was prevented from boarding a flight from Kenya to Hawaii at her late stage of pregnancy, which apparently was a normal restriction to avoid births during a flight. It is likely that Stanley Ann Dunham (Obama) gave birth to Barack Obama in Kenya, after which she flew to Hawaii and registered Obama’s birth.
Yes, Mr. Obama, “… there’s some stuff that’s been left undone!” NOW SHOW THE WORLD YOUR ACTUAL BIRTH CERTIFICATE and all the stuff will be done!

That’s awsome. I typewriter that can type in a font that wasn’t created until 1983! Must have been stored in a ziploc bag in a dictionary for all those years. Mine looks like it went through a war, even though it sat in the same place since 73′.
